Terms & Conditions for Nexton Artisan Crafts & Flea

Market Vendor(s)

The Applicant(s) agree/agree to abide by the terms and conditions when participating in RYP Unlimited LLC’s Nexton Artisan Crafts &Flea Market Event upon payment of the booth(s) rental.

1. DEFINITIONS

1.1 “Vendor/Vendors” refers to the applicant(s) who rent a stall space at the Event. “Organizer” refers to RYP Unlimited LLC which is the Organizer of the Event. “Event” refers to Nexton Artisan & Flea Market organized by RYP Unlimited LLC.

2. RENTAL:

2.1 A rental fee of $50 per Stall Space shall be collected by the Organizer upon acceptance of this contract via website payment with a $2.75 online service charge. The event. Stall rental(s) are strictly non-refundable unless the event is canceled by the Organizer.

3. OPERATION:

3.1 Vendor(s) are only allowed to set up on the day of the event
3.2 Vendor(s) must set up 1 hour before the start timing of the Event unless stated otherwise. Vendors who are later than the commencement time of the event may result in forfeiture of the booth.
3.3 Vendor(s) are to start packing up half an hour before the event ends unless stated otherwise.
3.4 Vendor(s) who did not show up upon booth confirmation notice from the organizer at the Nexton Artisan Crafts & Flea Market! The event will result in forfeiture of the booth, rental fee and deposit.
3.5 Vendor(s) who did not receive any booth confirmation notice from the organizer but appear at the flea market event may be asked to leave the premises without bearing any cost or consequences by the organizer.

4. ALLOCATION OF STALL SPACE:
4.1 Vendor(s) are to refer to the RYP Unlimited LLC allocation policy’ for each Flea Market Event and adhere to the policy at all times.
4.2 Vendor(s) shall only be permitted to sell items that have been approved by the Organizer. The Organizer reserves the right to reject particular items.
4.3 TYPE OF PRODUCTS ENCOURAGED:

  • New products for resale
  • Artisans’ products and services fall under the categories of fashion, food, lifestyle, and handmade.

4.4 ITEMS RESTRICTION
ITEMS RESTRICTION OR SUBJECT TO PRIOR ARRANGEMENT:

  • Meat Products (products containing eggs and milk areallowed)
  • Counterfeit items
  • Pre-loved items
  • Torn and broken items
  • Utilization of dangerous implements and materials
  • Tarot cards/palm readers/fortune readers
  • Masseurs or masseuses
  • Art created by spray paint
  • Items suggestive of religious proselytizing
  • Financial and/or insurance services and assistance
  • Soliciting or appealing for donations in kind or cash
  • Multi-level marketing products and services
  • Any item that violates SC Law

4.5 Vendor(s) should inform the Organizer of the product(s) or service(s) to be sold during the event upon sign-up. Should there be any changes or additions to the product(s) or service(s) declared, it is the vendor(s) ’s onus to inform and seek approval from the Organizer.
4.6 Reasonable space between stalls has to be maintained at all times as this is a link; stock and/or empty crates/boxes/luggage, etc must not be stored outside Vendor(s) stall space during operating hours.
4.7 Vendor(s) are allocated space for 10×10 stalls. Vendors must bring their furnishings for their space i.e. tables, chairs, and canopy.
4.8 Music will be provided during the event, so usage of a self- owned sound system to draw patron(s) to vendor(s)’s stall(s) is prohibited,

5. TERMS & TERMINATION:
5.1 The organizer reserves the right to change the venue, and date of event at any point of time deemed necessary.
5.2 Organizer reserves the right to amend any terms and conditions without prior notice.
5.3 Organizer reserves the right to reject any application based on its absolute sole discretion without assigning any reasons.
5.4 Organizer reserves the right to terminate this contract immediately by notice in writing to the Vendor without providing any reason. Such termination shall not prejudice the rights and liabilities of either party against the other for any breach of this Contract.

6. REQUEST FOR POSTPONEMENT OF FLEA:
6.1 Any request to postpone/transfer an event booking must be made at least 1 week in advance before the event day with a valid reason to the discretion of the Organizer (dis)approval. Any request made less than 1 week before the event day will be rejected with no refund/transfer/postponement regardless of the reason stated.

7. LAWS AND REGULATIONS:
7.1 Vendors are responsible for complying with all applicable laws and regulations in South Carolina as imposed by the Government or lawful bodies of the State of South Carolina (including but not limited to any item that breaches the intellectual property rights of any third party; any item [including but not limited to cosmetics, food, and drinks, etc] that requires the prior approval of the relevant licensing authorities, such as NEA, HSA, etc and for which prior approval have not been obtained; any dangerous, offensive, pornographic or illegal items; any form of alcohol. Counterfeit goods are strictly not allowed.
7.2 Specifically, vendors selling food and beverages that require cooking or any other food processing methods must possess an NEA food shop license. Vendors selling food and beverages that require on-site assembly must be certified by WSQ- Follow Food and Beverage Safety and Hygiene Policies and Procedures.

8. BEST INTERESTS OF ORGANIZER:
8.1 Vendor(s) undertakes at all times action in the best interest of Organizer and shall not do or permit anything that may damage or prejudice the reputation of the Organizer or bring the Organizer into disrepute.

9. DECLARATION OF SALES:
9.1 If asked, Vendor(s) must declare Daily Gross Sales truthfully only upon request by the Organizer.

10. PUBLICITY OF EVENT
10.1 The vendor (s) undertakes publicity of the event on social media platforms using the marketing materials of the event provided by the Organizer.
10.2 Vendor(s)’ products may be featured on RYP Unlimited LLC’s YouTube Channel and its social media handles for publicity and marketing purposes. Vendor(s) who do not wish to be featured on these platforms should inform the Organizer upon confirmation. Any concerns that the selected vendor(s) may have, should be communicated to the Organizer before the filming/photography process. Vendor(s) may be required to supply samples of the
products to be featured for the marketing materials. Vendor(s)’ products that are featured in the marketing materials should accurately reflect the products to be sold at the actual event. The Organizer reserves the right to publish/use all marketing and publicity materials.

11. ORDERLY BEHAVIOUR OF VENDOR(S):
11.1 Vendor(s) are hereby given notice to conduct its business at the Facility in a professional manner so as not to give cause for complaints from occupants of the building or the public and to ensure that the image of the Organizer is not adversely affected. Examples of disorderly behavior
include touting, shouting, and promotion of products outside the boundaries of the assigned stall space.
11.2 Vendor(s) shall respect the health and safety of fellow Vendor(s). No acts or threats of physical and/or verbal violence against another person
(including sexual violence), disorderly conduct, and/or possession of dangerous articles (such as firearms, explosive materials, etc.) are allowed.

12. ABUSES TO PROPERTIES:
12.1 Vendor(s) are hereby given notice not to abuse by hanging or sticking anything onto the properties (Tables, Chairs, Walls, Floor etc) provided by the Organizer. Vendor(s) will be asked to leave the Event without any Rental and Deposit refund.

13. LOSS/DAMAGE TO PROPERTIES:
13.1 No properties within the venue shall be removed or to beshifted unless prior approval is given by the Organizer. The Organizer reserves the
right to report incident(s) of theft to the Police and it shall be dealt with under laws and regulations in Singapore as imposed by the Government or lawful bodies of the Republic of Singapore.
13.2 In the event of any loss/removal/damage caused to the venue and its furnishings/fixtures, Vendor(s) will be held liable for the loss, removal or damage and shall pay Organizer such sums as Organizer may determine for the loss or damage caused to the aforesaid.

14. USE OF SPACE:
14.1 Vendor(s) shall not affix or otherwise exhibit or place on passageways, tents, bridges, pillars, or the windows of the surrounding Building or any part thereof any nameplate, signboard, placard, poster, banner or advertising material or offensive publications or any goods or articles or the like whatsoever for any public announcement or which may contravene any statute or regulations or which may expose Organizer to
any fine or penalty by reason thereof.
Vendor(s) shall be held fully responsible and liable to pay a fine or
penalty caused to the aforesaid.
14.2 Vendor(s) are to adhere to the allocated stall space unless prior
approval is given by the Organizer.
15. LOSSES:
15.1 Vendor(s) are not allowed to place their goods or property overnight in
the venue before and after operation hours. For the avoidance of
doubt, under no circumstances will the Vendor(s) hold Organizer
responsible for any personal injuries, damage, loss or defacement of
goods or property on display occurring, during the event, no matter how it
was caused.
15.2 The Organizer will not be held liable and/or responsible for any
injuries, illness, and/or death that occurred before and/or after
and/or during the event.
15.3 The Organizer is not responsible for poor sales or bad
responses during any of our flea events.

16. ILLUMINATION & ELECTRICITY:
16.1 Vendor(s) who require power supply at their stalls should inform the
Organizer at least 1 week in advance and electrical points are chargeable at
$5 each. Electrical points will only be provided for fringe stalls due to
safety reasons. Photos of the equipment that requires electricity must be
provided upon vendor(s)’ request for power supply. The Organizer
reserves the right at their sole discretion to allocate power supply to
vendors.
17. CLEANLINESS & HOUSEKEEPING:
17.1 Vendor(s) are hereby given notice to keep the Facility clean and tidy
and shall not litter, deface, or damage the Facility. The area must be
cleared and kept clean after use, with the waste, boxes, cardboard, and
refuse properly disposed of in the bin center located at the entrance of
the parking lot.
18. PARKING AND/OR LOADING/UNLOADING:
18.1 Loading/unloading of goods is strictly prohibited at the entrance of
Nexton Elementry. The vendor may proceed to the
loading/unloading bay at the set-up time and the official end of the event.
18.2 Failure to abide by any of the above Terms and Conditions will result in
the bearing of any compensation, penalties, and/or legal fees resulting
from the violation, removal of the Vendor from the event with no refund,
and/or imposing of a permanent ban.
18.3 Nexton Elementary and RYP Unlimited LLC reserves the
right to make changes, including changes in content, description, terms,
location of the event, etc. at any time without prior notice or bearing
any legal cost.
